Terms and Conditions

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE BIGSTONE APP.
1. Agreement
By creating an account, binding a vehicle, or using the Services, you agree to these Terms & Conditions ("Terms") and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 16 years old (or the age of digital consent in your country) and have the legal capacity to enter into a binding agreement.
3. Account Security
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of unauthorized use.
4. Vehicle Binding and IoT Services
• You may bind up to three vehicles per account unless we state otherwise.
• You represent that you are authorized to bind and control the vehicle.
• IoT features (location, lock, alerts, ride recording) depend on network coverage, device hardware, subscription status, and server availability.
• We do not guarantee uninterrupted or error-free connectivity.
5. Acceptable Use
You agree not to:
• Use the Services unlawfully or to harm others;
• Interfere with or reverse engineer the Services except as permitted by law;
• Misrepresent vehicle ownership or tamper with telemetry;
• Use remote controls in a manner that endangers people or traffic safety.
6. Safety and Disclaimer
E-bike control features are assistive tools only. You remain solely responsible for safe operation of your vehicle, compliance with traffic laws, and verifying lock/status before relying on the app. Bigstone is not liable for accidents, theft, or damage arising from use or failure of the Services.
7. Subscription and IoT Plans
If an IoT data plan is required, features may be limited when a plan expires. Fees, renewal terms, and refunds are governed by the plan presented at purchase and applicable consumer laws.
8. Intellectual Property
The app, branding, software, and documentation are owned by Bigstone or its licensors. You receive a limited, non-exclusive, revocable license for personal use in connection with your vehicles.
9. Third-Party Services
Maps, app stores, and connectivity providers are third-party services subject to their own terms. We are not responsible for third-party outages or content.
10. Limitation of Liability
To the maximum extent permitted by law, Bigstone shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our aggregate liability for claims relating to the Services shall not exceed the greater of (a) amounts you paid us in the 12 months before the claim or (b) USD 50, except where liability cannot be limited under mandatory consumer protection law.
11. Warranty Disclaimer
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are prohibited.
12. Termination
You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms, security risks, or legal requirements. Provisions that by nature should survive will survive termination.
13. Governing Law and Disputes
These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence require otherwise. Courts in Nanjing, China shall have jurisdiction where permitted; EU/UK consumers may also have the right to bring claims in their country of residence.
14. Changes
We may modify these Terms. We will provide notice of material changes through the app or other reasonable means. Continued use after the effective date constitutes acceptance where allowed by law.

1. 协议

2. 资格
您须年满16周岁（或您所在国家/地区规定的数字同意最低年龄），并具备订立有约束力协议的法律能力。
3. 账户安全
您须对凭证保密及账户下一切活动负责，发现未授权使用请及时通知我们。
4. 车辆绑定与 IoT 服务
• 每账户最多绑定三台车辆（除非我们另行说明）；
• 您声明有权绑定并控制该车辆；
• IoT 功能（定位、锁车、告警、骑行记录）取决于网络、硬件、套餐状态及服务器可用性；
• 我们不保证连接持续无中断或完全无错误。
5. 可接受使用
您同意不：
• 违法使用服务或损害他人；
• 干扰或逆向工程服务（法律允许除外）；
• 虚假陈述车辆权属或篡改遥测；
• 以危及人身或交通安全的方式使用远程控制。
6. 安全与免责
电动自行车控制功能仅为辅助工具。您对安全驾驶、遵守交通法规及使用前核实锁车/状态负全责。因使用或未能使用服务导致的事故、盗窃或损害，大石不承担责任。
7. 订阅与 IoT 套餐
如需 IoT 数据套餐，套餐过期后功能可能受限。费用、续费与退款受购买时展示的方案及适用消费者法律约束。
8. 知识产权
应用、品牌、软件及文档归大石或其许可方所有。您获得有限的、非独占、可撤销的个人使用许可。
9. 第三方服务
地图、应用商店及连接服务受各自条款约束，我们不对第三方中断或内容负责。
10. 责任限制
在法律允许的最大范围内，大石不对间接、附带、特殊、后果性或惩罚性损害，或利润、数据、商誉损失负责。与我们服务相关索赔的累计责任不超过（a）索赔前12个月您向我们支付的金额或（b）50美元中的较高者，强制性消费者保护法另有规定的除外。
11. 保证免责
服务按「现状」及「可用性」提供，不作明示或默示保证（包括适销性、特定用途适用性及不侵权），法律禁止免责的除外。
12. 终止
您可随时停止使用。我们可因违反条款、安全风险或法律要求暂停或终止访问。依性质应继续有效的条款在终止后仍然有效。
13. 适用法律与争议
本条款受中华人民共和国法律管辖（法律冲突规则除外），您居住国强制性消费者保护法另有规定的除外。在允许范围内由南京市有管辖权的法院管辖；欧盟/英国消费者亦可能有权在居住国提起诉讼。
14. 变更
我们可修改条款，重大变更将通过应用或其他合理方式通知。法律允许时，更新后继续使用视为接受。
